Terms of Service

These terms are the agreement between you and us, written plainly.
1. Who we are, and who may use KindFable
KindFable is operated from Coquitlam, British Columbia, Canada. In these terms “KindFable”, “we” and “us” mean the operator of the service, and “you” means the adult using it — you must be 18 or older, or the age of majority where you live, to buy anything or upload a photo. KindFable is made for a parent or legal guardian to use on a child’s behalf, never for a child to use alone. The quickest way to reach a person is support@kindfable.com.
2. The photos you upload — your promises to us
When you upload a photo, you promise us that:
- you are the parent or legal guardian of the child the book stars;
- any other person in a photo has given you permission — or their parent or guardian has, if they are a child;
- you have the right to share the photo: it is not someone else’s copyrighted work, a stock image, or a picture of a public figure or a stranger; and
- you understand it will be sent to our AI provider so a cartoon avatar can be drawn from it — the details, and what we keep, are in the Privacy Policy and the box you tick before it goes anywhere.
If someone brings a claim against us because one of those promises was not true, you agree to cover our reasonable losses and legal costs. That never applies to anything caused by our own mistake, and it never reduces your consumer rights.
3. What AI makes, and what to expect
The avatar is a stylised drawing inspired by the photo, not a portrait — recognisable and lovable rather than accurate, and we cannot promise a particular likeness. Every generation is unique: a remade or second book gets different pictures, and AI-made stories, illustrations and audio can contain small inaccuracies, so please read a book through before sharing it with your child. Printed colours are warmer and softer than a glowing screen, and small variations in colour, trim and finish are normal in print-on-demand — not a fault.
4. Your content, and the finished book
You keep ownership of the photos and details you give us; we use them only to make and deliver your books and run the service. The finished works — the book, its audiobook and its story song — are yours to keep, forever: we assign you every right we hold in them and, where a right cannot be assigned, we license them to you perpetually and royalty-free to read, print, download, gift and share, including publicly but non-commercially. Selling or commercially republishing them is not included, and because copyright in AI-generated art is unsettled law, we cannot promise the copyright you receive is enforceable against others. We keep the KindFable name, logo, software and designs; the sample books on our site are demos we made ourselves — no real customer’s child appears in them.
5. Acceptable use
Please don’t:
- upload a photo of a child you are not the parent or legal guardian of;
- upload a photo of a public figure, or of anyone who has not agreed;
- ask for stories or images that are unlawful, hateful, sexual, frightening or cruel, or aimed at harassing a real person;
- overload, scrape, resell or reverse-engineer the service.
Automated safety checks screen what goes in and what comes out. When they refuse something, the book stops rather than being delivered, and we may remove content or suspend an account that breaks these rules. A refusal can also be a false alarm on an innocent photo — email support@kindfable.com and a person will look at it.
6. Prices & payment
Starting a book and seeing its cover is free. You pay before the rest of the pages are painted — a one-time purchase per book, never a subscription.
- Softcover — $39 USD. Includes the full digital book, its PDF, and a song written from the story.
- Hardcover — $69 USD. Includes the full digital book and its PDF, plus the narrated audiobook, the story’s song, and free shipping.
- A standalone audiobook or story song — $7.99 USD each (one audio credit makes one).
Prices are in US dollars and exclude shipping and sales tax — both are shown for your address before you pay. The exception is the hardcover, which ships free everywhere we deliver; softcover orders pay the shipping shown at checkout. Payment is handled by Stripe; we never see or store your full card number. The price shown when you order is the price for that order.
7. Where we can sell right now
For now we cannot accept orders from the European Economic Area, the United Kingdom or Switzerland — not a printed book, and not the digital book, the narration or the story song either. Those countries are not offered as a delivery address, and a purchase started from one of them is refused before any payment is taken; if an order reaches us anyway, we may cancel it and refund you in full. Everything free stays free, everywhere — only the paid step is closed, and if that changes we will say so here.
8. Printing, delivery & addresses
Nothing is printed until you confirm it. You see the finished book first, and the printing file is only made after you press confirm — so a typo is yours to catch while it still costs nothing.
If you forget to confirm. We email you when the book is ready, then up to two reminders. If a printed copy is paid for and a week or more has passed, our team may review the finished book and — if the quality is right — confirm and release it to printing for you; it is then treated the same as a book you confirmed, and the refunds section applies as usual.
Printed books are produced and shipped for us by a specialist print-on-demand partner, which receives the full delivery address you enter. The countries offered at checkout are the ones we can sell to.
How long it takes. Your copy is printed to order, then posted; the window covers both stages, in business days:
- United States, Canada, Australia, India — 13–18 business days. Printed in your own country, so it never crosses a border.
- New Zealand and Mexico — 15–25 business days. Printed at the nearest press and posted from there.
- Everywhere else we deliver to — 18–35 business days. A longer postal journey, and usually a customs step.
Whenever our printer can quote your exact address we show you its window instead, before you pay, and that quote is the one to go by. Your digital book and its PDF are ready the moment payment goes through — nobody waits on the post to read the story.
Delivery windows are estimates, not promises. Printing queues, weather, customs and holidays all move them — please leave room before a birthday. If a parcel has clearly gone astray, tell us and we will chase it and make it right.
Customs. If your parcel crosses a border, import duties, customs and handling fees are yours — they are charged by your customs authority or carrier, not by us. A book printed inside your own country has no import step. A parcel refused or abandoned at customs is treated as a wrong-address case below.
Damaged in transit. Email us within 30 days of delivery with a photo of the damage and we will reprint the book or refund you — your choice.
Wrong or incomplete addresses. Please check the address before you confirm; you can ask us to change it any time before the order goes to the printer. If a parcel is lost because the address you gave was wrong or incomplete, we can’t recover the print cost and a corrected copy is a new order — email us anyway; we would rather help than win the point.
9. Returns & refunds
We stand behind every book. The moment you approve one, those exact pages go to a printing press — so the two stages have different promises.
Before you approve — anything at all, with no clock running. Nothing is printed until you press Confirm. If the story, the likeness or a page is not what you hoped for, regenerate it yourself in the Studio — or simply don’t confirm, and email support@kindfable.com: we will either give you the credits to make it again or refund you in full. Your choice.
After you approve — printing and delivery problems, for 30 days from delivery. The artwork and words are settled — they are the ones you saw and chose. What we still cover is anything that went wrong in the making or the shipping of the book:
- pages that arrive damaged, torn, creased or stained;
- binding faults — loose, upside-down, duplicated or missing pages;
- printing faults — smearing, banding, a blank page, misaligned artwork;
- the wrong binding, the wrong book, or a book that never arrives at all.
Email us a photo of the problem and we will print you a fresh copy free of charge — or refund you in full if a reprint is not possible or the replacement has the same fault. You never need to post the book back.
What the 30 days does not cover:
- a change of mind about a book you already approved;
- anything you could see in the preview before you confirmed;
- details you entered yourself — a name, an age, a dedication;
- normal print-on-demand variation (see “What AI makes”);
- damage after delivery, or a delivery that failed because the address was wrong.
If our printer rejects or cancels a paid job so it can never ship, we refund that order automatically and email you. Every other refund needs your email — nothing else in our system issues one on its own, and deleting a book from your library does not cancel an order or trigger a refund.
So this stays fair for everyone: we may ask for photographs of a fault, send one replacement per order for the same defect, and decline a claim that is plainly not a manufacturing fault. Refunds go back through Stripe to the card you paid with, normally within 5–10 business days. Everything in this section sits on top of the rights the law gives you — it never replaces them.
For customers in Australia: our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
10. Liability
To the fullest extent permitted by the law where you live, our total liability for any claim connected to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses; where a limit here is not permitted, it does not apply to you.
11. Ending things, and chargebacks
You can stop using KindFable whenever you like, and have your account and its data deleted by emailing privacy@kindfable.com — we confirm by email when it is done, and the Privacy Policy says exactly what is removed. We may suspend or close an account that breaks the acceptable-use rules, and if we ever close yours without cause we will refund any order we haven’t delivered. If something is wrong with an order, please email us before opening a bank dispute — a refund from us is faster, and we may pause printing while a dispute is open.
12. Changes, and the small print
We may update these terms as the product grows; a material change is announced in-app or by email before it takes effect, and the terms that apply to an order are the ones in force when you placed it. Neither of us is responsible for what is genuinely beyond our control. If part of these terms turns out unenforceable, the rest still stands. These terms and the Privacy Policy are the whole agreement between us about the service.
